TERMS & CONDITIONS
These terms set out the basis on which Kelpstone provides yacht charter services. Please read them before making a booking. Last reviewed April 2026.
1. DEFINITIONS
Kelpstone refers to the yacht charter operator based at 83/1 Boat Lagoon Marina, Koh Kaew, Phuket 83200, Thailand. Guest refers to any person who books or participates in a charter. Charter refers to any sailing trip arranged through Kelpstone, including day cruises and multi-day passages. Captain refers to the Kelpstone crew member in command of the vessel at any given time.
2. BOOKING AND CONFIRMATION
A booking is considered confirmed when Kelpstone has acknowledged it in writing (by email) and a deposit has been received. Enquiries submitted through the website do not constitute a booking until confirmed by Kelpstone in writing.
Please ensure that the information you provide when booking is accurate, particularly regarding group size and any relevant medical conditions or mobility requirements. This allows us to prepare appropriately and, where necessary, advise on suitability.
3. PAYMENT
3.1 Deposit
A deposit of 30% of the total charter fare is required to hold a booking. The deposit is payable within 48 hours of receiving a written booking confirmation from Kelpstone. If payment is not received within this period, Kelpstone reserves the right to release the dates.
3.2 Balance
The remaining balance is due no later than 7 days before the charter departure date. For bookings made within 7 days of departure, the full amount is payable at the time of confirmation.
3.3 Currency and method
Payments are accepted in Thai Baht (THB). We accept bank transfer, credit card, and cash at the marina office. Any bank transfer fees are the responsibility of the guest.
4. CANCELLATION AND CHANGES
4.1 Cancellation by the guest
Cancellations must be communicated in writing to [email protected]. The following schedule applies: cancellation more than 14 days before departure — deposit forfeited, balance refunded in full; cancellation 7–14 days before departure — 50% of total fare retained; cancellation fewer than 7 days before departure — 100% of total fare retained.
4.2 Date changes
We will accommodate date changes where vessel availability allows, subject to a date change fee of ฿1,500. Date changes must be requested at least 7 days before the original departure date.
4.3 Cancellation by Kelpstone
Kelpstone reserves the right to cancel or postpone a charter if sea conditions are assessed by the Captain as unsuitable for safe passage, or if mechanical or technical issues with the vessel require it. In such cases, guests will be offered an alternative date or a full refund of amounts paid. Kelpstone's liability in these circumstances is limited to the refund of monies received.
5. WEATHER AND CONDITIONS
The Captain's assessment of sea and weather conditions is final. Kelpstone does not offer compensation for shortened or modified itineraries that result from conditions encountered during the charter, provided that changes were made in the interests of passenger safety. We will always communicate the reasoning for any such changes.
6. PASSENGER RESPONSIBILITIES
Guests are expected to follow the reasonable instructions of the Captain and crew at all times. Behaviour that compromises the safety of the vessel or other passengers may result in the charter being terminated, with no refund of unused fare.
Guests are responsible for ensuring they are in a suitable physical condition to participate. Kelpstone should be informed in advance of any significant medical conditions, particularly those relating to motion sickness, mobility, or cardiac or respiratory health.
Guests who consume alcohol during a charter do so at their own risk. The Captain may refuse boarding or require a guest to remain below deck if their condition poses a safety concern.
7. CHILDREN
Children under 12 must be accompanied by a responsible adult at all times. Life jackets are available onboard and children under 12 are required to wear them at all times when on deck in open water. Parents and guardians are responsible for supervising children throughout the charter.
8. PERSONAL BELONGINGS AND LIABILITY
Guests bring personal belongings aboard at their own risk. Kelpstone does not accept liability for loss of or damage to personal items. We recommend that guests do not bring items of significant financial or sentimental value.
Kelpstone maintains third-party liability insurance appropriate to its operations. Guests are advised to carry their own travel insurance, including medical evacuation cover, which is particularly relevant for multi-day passages.
9. DAMAGE TO THE VESSEL
Guests are liable for any damage to the vessel, its equipment, or onboard items caused by deliberate misuse or gross negligence. The Captain will document any such damage at the time it occurs.
10. INCLUSIONS AND EXCLUSIONS
Each route's inclusions are described on our Solutions page and in the booking confirmation. Items not listed as included — such as personal drinks beyond those specified, optional shore excursion fees, or additional equipment hire — are at the guest's cost.
11. PHOTOGRAPHS AND PRIVACY
Guests consent to photographs being taken during the charter that may be used by Kelpstone for promotional purposes, including on this website and social media. If you would prefer not to be photographed, please inform a crew member at the start of the charter. We will respect this request throughout.
12. GOVERNING LAW
These terms are governed by the laws of Thailand. Any disputes arising from a charter arrangement will be subject to the jurisdiction of the Thai courts.
